I am going through a divorce now with my spouse. The legal fees are adding up and I'm wondering if any of the fees are tax deductible?

Unfortunately, the IRS generally prohibits any tax deduction for the cost of personal advice, counseling and legal action in a divorce. The only instance in which legal fees may be deductible is if the costs were to produce or collect taxable income. For instance, alimony is considered taxable income. Therefore, if an agreement was established for alimony, then legals fees in connection with alimony would be tax deductible.
