I have a client who is on Social Security Disability Insurance, but recently inherited a seasonal flea market and the entirety of booth rental income has historically been reported on IRS Schedule E. This suggests that the income is treated as passive it and would not disqualify her from her SSDI?

ANSWER

The BIDaWIZ Team's Answer:

Yes, if she is not actively involved in the business and just receives rental income from it, it would be considered a passive activity. This is referenced in Internal Revenue Code Section 469(c)(2) and IRS Publication 925. Her SSDI would not be impacted.
