I am a military dependent living and working in Guam. My husband is a Georgia resident. Should my income be included when filing state taxes?

ANSWER

Expert Thomas Graham iii's Answer:

Yes, your income should be included when filing state taxes based on your legal state of residence (home of record).  Basically, if your legal state of residence was Georgia when you entered the armed forces, and you have not legally changed your residency, you are still an Georgia resident, although you are stationed overseas.  Therefore, it will be necessary to report all your income on your Georgia return whether it was receive within or outside of Georgia. You would be eligible to file a joint return with your husband who currently resides in Georgia as well.
