A friend is planning to marry a woman who has a $350,000 IRS tax judgment against her. Her former husband took his life instead of fighting the IRS. Will my friend be responsible for any of that debt if they marry?

ANSWER

The BIDaWIZ Team's Answer:

No: he is not liable for her tax liability; however, if they

elect to file jointly, he must must include an "injured spouse"

form [Form 8379], with the tax return, to indicate that he is not liable,

for her pre-marital tax debt, and he must indicate "injured spouse"

in the upper left corner of the Form 1040.
